Terms of Service
AB.delivery is a technology platform (load board, dispatch, tracking, TMS). We are not a motor carrier. Transport is performed by independent carriers and drivers.
Shipper: accurate cargo details, access, documents.
A booking forms when a confirmation is issued or accepted in platform. Cancels via app or email. Accessorials require timestamp and location and proof (photos, BOL notes).
Rates may be flat or RPM. Terms are shown on confirmation. Disputes within 10 days with documentation.
No illegal or misdeclared cargo.
No spoofing, scraping, or unauthorized access.
No forged documents or fraud.
Services are “as is.” We do not control third party carriers. Liability is limited to fees paid to us in the prior 3 months for the service at issue.
Nevada law; arbitration in Clark County, NV, except eligible small claims matters.

Privacy Notice
Account: name, email, phone, company, role.

Safety
Driver vetting: license and authority checks, background where required, MVR cadence.
Equipment: maintenance attestations; pre and post trip checks.
Hazmat and heavy haul: permits, escorts, placarding per carrier unless agreed in writing.
EV and fuel: use OEM and local guidance; battery fire procedures differ from fuel fires.
Incident response: ensure safety, call 911 if needed, notify dispatch, collect photos and documents.

Brokers
FMCSA broker authority: MC number active
Surety bond or trust: BMC-84 bond or BMC-85 trust, 75,000 minimum
BOC-3 process agent filing
UCR registration: current year
Contingent cargo insurance: common in the market but not a federal mandate. Many shippers require proof. Typical limit: 100,000 or higher per contract
General liability: recommended per contract requirements
Data security and document controls for COI, W-9, authority, and carrier vetting artifacts
Shippers
Cargo insurance for owned goods: limits set by commodity and value
Declared value and special handling instructions: temperature control, high value, hazmat, over-dimension, or time definite
Packaging and load securement suitable for mode and lane
Claims process alignment: visible contact, documentation expectations, timelines
Carriers and Drivers
Operating authority: USDOT number and MC number active if required by lane and commodity
Insurance filings: BMC-91X liability filing on file with FMCSA where required
Auto liability: 1,000,000 typical for general freight. Federal minimums vary by commodity and weight
Cargo: 100,000 typical. Higher limits for high value, hazmat, or special classes
Workers compensation: where required by state
Additional coverages by use case: trailer interchange, non-trucking liability or bobtail, reefer breakdown, occupational accident for qualifying owner-operators, MCS-90 endorsement where applicable
BOC-3 process agent filing and UCR registration: current year
IFTA and IRP: for qualifying power units running interstate. HVUT Form 2290 as applicable
Vehicle: registration, annual inspection, current permits and decals kept in vehicle
To employ a driver and legally move a unit
Driver qualification file: completed application, prior employer checks, road test or equivalent, CDL copy, medical certificate, MVR queries per cadence
FMCSA Clearinghouse: pre-employment query completed and driver enrolled in random testing program
Drug and alcohol test: negative result on file before safety-sensitive duty per DOT rules
Training and policies: HOS, ELD use, cargo securement, accident procedures, device policy if tracking is enabled
ELD installed and configured for qualifying CMVs. HOS rules understood for the lane
Pre-trip and post-trip inspections recorded. DVIR availability in cab or app
Proof of insurance, registration, permits, and required emergency equipment in vehicle
PPE as required by shipper or site: safety vest, hard hat, eyewear, gloves, closed-toe footwear
COI upload cadence with reminders. Access can be denied if coverage is expired or filings are not in good standing. These items are informational and may not cover every jurisdiction or commodity. Contract terms control.
Claims
Notify promptly; include photos, POD, BOL, seal or temperature logs (if any).
File via Dispatch, receive ticket ID, track status. If needed, email claims@ab.delivery.
Allocation depends on contract (broker vs carrier).
Appeal by submitting additional documentation; we will review and respond with a timeline.
